"Six members of Concerned Tshwane Residents (CTR) went to Khan's premises in Luttig Street, Pretoria West on 1 February 2020. They wanted to confirm that he was indeed the real owner of the property in question, ”says Mahanjana. "Upon their arrival, Khan and a member of CTR started fighting. Khan brought out a firearm and shot dead the member and bystander. He tried to shoot another member of the CTR team. "
According to eyewitnesses, members of the CTR went to the police station to report the case. "Upon their arrival, they saw Khan and for fear of what he might do, they did not enter the police station. "They returned to the scene where the shooting took place."
Police later arrived at the scene and the case was reported. Two days after the incident, Khan turned himself in to police. He has been in custody since his conviction.
The father of the deceased Avelo Mbewu said in his victim impact statement to the court that his wife had a miscarriage after hearing that their 20-year-old son had died.
Prosecutor Adv. Eric Sihlangu claims Khan showed no remorse for his actions.
Judge Masopa said Khan's actions could not be justified. He did not take the court into his confidence by testifying or explaining why he committed the crimes. Masopa also believes Khan does not show any sign of possible rehabilitation.
